How do I get my firearm back from the Police Department?
Firearms taken as evidence of a crime cannot be returned to the owner without a release from the investigating officer, prosecutor, or judge.
For firearms taken for safekeeping or that were taken as evidence but have been properly released, a back ground check must be conducted on the owner.
Every firearm must also be traced through the ATF Tracing Center (this can take up to a month or longer). Once the background check and firearms trace is completed and it is determined the firearm may be returned, the owner should call the Property and Evidence Section of the Police Department at 304-348-6426 extension 221 or 222 to set up an appointment to have the firearm returned to them.
When picking up your firearm you will need a valid photo ID and a gun case to secure the weapon in.
